Subject:        COMPUTER ALLOWANCE/AMENDMENT IN POLICY OF COMPUTER ALLOWANCE.

Respected Sir,

                        With profound regards, it is submitted that I being the S.V.President, Welfare Associaiton for Stenographers, Stenotypists and Private Secretaries of All Pakistan Secretariat Employees Coordination Council and on their behalf have the honour to request  the addition of designation of Stenotypists, Stenographers(PAs) and Private Secretary in the Policy of Computer Allowance circulated vide Finance Division O.M No.F.20(4)/R-5/90 dated 25.09.1992.

                   Apart from other qualification, Computer Litracy has been shown as “Must” in the Recruitment Rules of Stenotypists,Stenographers and Private Secretary.  As they are working simultaneously and computer is a whole time job, therefore they are entitled for Computer Allowance.  Finance Division vide their O.M No.F.20(4)/R-5/90 dated 25.09.1992 at Para 7 has also allowed computer allowance to those persons who are working as whole time job on computer.

                   The following designations may kindly be added in the eligible list of designation for Computer Allowance.

With due respect it is stated that Computer Litracy is a Qualification in the recruitment rules of Steno-typist & Stenographers, and I am working on computer simultaneously & computer is my whole time job. I am entitled for Computer Allowance as per para 7 of the Finance Division O.M No.F.20(4)R-5/90 dated 25.9.1992 (Copy enclosed).

It is requested that computer allowance @ Rs.1500/- may kindly be allowed to me w.e.f 23.12.2011 and oblige.

Similarly if research work or design work is the whole time job of an employee, he will draw only Research Allowance or Design Allowance, as the case may be, provided he fulfills the requirements laid down.

مکرمی! سپریم کورٹ کے حکم پر وفاقی گورنمنٹ فنانس ڈویژن اسلام آباد نے وزیراعظم کی منظوری سے سٹینو گرافر اور پرائیویٹ سیکرٹریز کے سکیل اپ گریڈ کئے تھے اور اس سلسلے میں باضابطہ نوٹیفکیشن نمبر F.No.19(55) Legal-II/2011- 1055 مورخہ 23-12-2011 کو جاری ہو چکا ہوا ہے مزید نوٹیفکیشن کی کاپیاں تمام چیف سیکرٹریز/ فنانس سیکرٹریز کو عمل درآمد کیلئے باضابطہ طور پہنچ چکی ہیں لیکن پنجاب گورنمنٹ نے ابھی تک صوبائی سٹینو گرافرز اور پرائیویٹ سیکرٹریز کے سکیل اپ گریڈ نہیں کئے جوکہ انصافی ہے جبکہ 11 ماہ کا عرصہ گزر چکا ہے۔ جبک خیبر پی کے کی گورنمنٹ نے اپنے صوبائی سٹینو گرافرز/ پرائیویٹ سیکرٹریز کے سکیل مورخہ 23-12-2011 سے اپ گریڈ کر دئیے ہیں اور باضابطہ نوٹیفکیشن نمبر FD/SO (FR) 10-22/2012 مورخہی 19-06-2012 کو جاری ہو چکا ہے۔ آئین کی آرٹیکل 25 کے مطابق ”پاکستان کے تمام شہری قانون کی نظر میں برابر ہیں اور قانونی تحفظ کے مساوی طور پر حقدار ہیں“ اس زمرے میں جناب چیف جسٹس سپریم کورٹ آف پاکستان کی رولنگ موجود ہے جوکہ 2009 SCMR 187 ہے۔جناب محترم وزیراعلیٰ شہباز شریف صاحب جوکہ خادم اعلیٰ ہیں درخواست ہے کہ پنجاب کے سٹینو گرافرز اور پرائیویٹ سیکرٹریز کے سکیل مورخہ 23-12-2011 سے سپریم کورٹ/ فنانس ڈویژن کے حکم کے مطابق اپ گریڈ کئے جائیں۔ شکریہ(محمد شفیق مغل سٹینو گرافر 0300-4649502)

All the Stenographers (BPS-16) may be requested to got forward their Record of Service i.e. Service Book and Leave Account duly completed from their departments to their respective Audit Offices for maintenance of their Record of Service i.e. History of Service and Leave Account and issuance of their Pay Slips under the following rules and regulations: -

S.R.    215(a).
The leave account of a gazetted Government servant shall be maintained by, or under the direction of, the principal auditor responsible for the audit of his pay.

The record of the service of a BPS-16 & above officers is kept by the respective audit officer in such form as may be prescribed by the Auditor General of Pakistan.  In pursuance of these powers the Auditor-General has decided that a ‘History of Service’ will be maintained for every gazetted officer, which will contain the following information:-

Name; Qualification; Date of birth; Date of joining service; Domicile; Province of origin; Mother tongue; Stations of appointment; Dates of officiating substantive appointments; Leave and suspensions, etc.

Any literary work done by the Government servant or any title conferred upon him are also mentioned therein.

With profound regards, it is submitted that I being the S.V. President, Welfare Association for Stenographers, Steno-typists and Private Secretaries of All Pakistan Secretariat Employees Coordination Council and on their behalf have the honour to Appeal/request the following genuine demands to your honour for favorable consideration please.

Grant of Time Scale for Stenographers(PAs) and Steno-typists.

The existing Stenographers (PAs)/Steno-typists already working in BS-16 and BS-14 from 1983 (rendering 30 years service in BS-16 and BS-14) have been deprived to consider/ give any promotion benefit, whereas they have only one to two years service to attain the age of superannuation, how they would get promotion benefit of Private Secretary (BS-17/BS-18)? The existing Stenographers/Steno-typists working in BS-16/14 may be granted time scale BS-17/BS-16.

Stenographers (PAs) Working with BPS-20 Officers and Head of Departments have no way of promotion. Mostly Stenographers are working in BPS-16 have no chance of promotion because BPS-17 Private Secretaries are entitled to BPS-21 and above officers. Steno-typist and Stenographers already working in BPS-14/16 may be granted time scale BPS-16/17 on the condition of three years service in BPS-14/16. The newly upgraded Stenographers and steno-typists may also be granted time scale BPS-17/16, irrespective of their length of service or on the completion of three years service in BPS-14/16 and the Nomenclature of Stenographer may kindly be changed as Assistant Private Secretary.

COMPUTER ALLOWANCE.

Private Secretaries, Stenographers and Steno-typists are entitled for Computer Allowance as recommended by the Law and Justice Division in the Up-gradation Case of Steno-typists, Stenographers and Private Secretaries.

It is requested that Computer Allowance may kindly be allowed to the Steno-typist , Stenographers and Private Secretaries on the following rates:

INDUCTION OF PRIVATE SECRETARIES IN O.M.G GROUP.
In Provincial Governments quota are reserved for Private Secretaries for Induction in the P.M.S. But in the Federal Government there is no quota for induction of the Private Secretaries. PRIVATE SECRETARY BPS-17 IF THE QUALIFICATION OF THE PS IS SAME AS THE OMG OFFICER THEN OPTION MAY BE EXERCISED EITHER HE REMAINS IN THE P.S LINE( ON THE ANALOGY OF FEDERAL GOVERNMENT RULES ) OR HE WANTS TO JOIN OMG ( Secretariat Group) AS SECTION OFFICER.
It is requested that quota may kindly be reserved for Private Secretaries for Induction into the O.MG (Secretariat Group).

I HAVE SOME PROPOSAL WHICH IS ALREADY CONVEYED TO THE MINISTRY OF FINANCE AND ESTABLISHMENT DIVISION.

1. Upgrade the post of LDC from BPS-07 to BPS-9.
2. Upgrade the post of UDC from BPS-9 to BPS-11
3. Upgrade the post of Assistant from BPS-14 to BPS-15
4. Upgrade the post of Assistant Incharge from B-15 to B-16
5. Grant of BPS-17 to the Suprintendents (BPS-16).
6. Time Scale for Stenotypist from (B-14 to B-15)
with a length of three years service.
7. Time Scale for Stenographer (B-16 to B-17).
with a length of three years service.
8. Time Scale to Auditors from B-11 to B-14
9. Time Scale to Senior Auditors from B-16 to B-17.


After the upgradation of the above posts and time scale the upgradation O.M may be withdrawn.

Mr. Khalid Riaz Stenographer Office of the Accountant General, Khyber Pakhtunkhwa, Peshawar filed an Appeal No.1123(P)/CS/2010 before the Federal Service Tribunal, Islamabad for Promotion as Superintendent now Assistant Accounts Officer (BPS-16) against 10% quota reserved for Stenographers vide Establishment Division O.M No.F-18(18)/70 dated 23.06.1973(reproduced at Serial No.198 page 184 of ESTA CODE 1990) Edition (Annex:A) giving reference of precedent of such promotion in the office of the Director General, Audit K.P Peshawar vide his office letter No.Admn:Audit/C-12/2009-10/1813 dated 29.09.2010 (Annex:B)
On 23.07.2011 the Federal Service Tribunal Islamabad announced the Judgment (Annex:C) in his favour and directed the respondents to consider the claim of the Appellant subject to his eligibility and suitability for Promotion as Assistant Accounts Officer (BPS-16) in the light of cases of M/S Muhammad Zakir and Munir Hussain of the office of the Director General, Audit Khyber Pakhtunkhwa Peshawar.(Annex:D) As per the Audit Manual Revised Edition 1988 Page 4 Sl:No.9 (Note)---- Here and elsewhere the term “Superintending staff” should be held to mean members of the Subordinate Accounts Service (SAS) or Accountants. Which is re-designated as Assistant Accounts Officer vide Notification No.656-Estt-III-46-86 dated, December 7, 1995.
As a result of the said Judgment of the Federal Service Tribunal, Islamabad a case for antedation /promotion of all effected personnel was sent to the Controller General of Accounts, Islamabad vide Accountant General Khyber Pakhtunkhwa letter No.Admn:I-37/Promotion AAO/1838 dated 29.10.2011 (Annex:E) to allow the office of the Accountant General, Khyber Pakhtunkhwa Peshawar to implement the said Judgment of the Federal Service Tribunal Islamabad.
The appellant submitted another appeal for the implementation of the Judgment in the light of the Federal Service Tribunal decision which was forwarded to the CGA with the request for permission to implement the judgment of the Tribunal.(Annex:F).

In response the Controller General of Accounts Islamabad permitted vide his Office letter No.529/Estt-III/Court/273-C/2010 dated 14.12.2011 (Annex:G) to implement the Judgment of the FST considering the eligibility and suitability of the Appellant in the light of Para 8 of the said Judgment. and the suitability may consider by the Departmental Promotion Committee.
The Finance Division submitted in its comments with the prayer that the appellant claim for promotion as Stenographer/Assistant Accounts Officer (Superintendent) which is an administrative matter and its has no concern with the employees of CGA. (Annex:H).
The Accountant General is competent to arrange DPC upto BPS-16 vide CGA Letter No.Estt:III/DPC/304/2011/527 dated 18.11.2011 (Annex:I) and for BPS-17 and above the case will be referred to CGA for holding DPC. In the cases of M/S Muhammad Zakir and Munir Hussain DPC was arranged by the DG Audit, Peshawar.(Annex:J). The Cabinet Secretariat Establishment Division Islamabad has issued a Notification Vide S.R.O 733.(I)/2005 dated 22.07.2005 which says “ 7-A(1). The Competent Authority may approve the promotion of an officer or official from the date of which the recommendation of Central Selection Board or as the case may be, the Departmental Promotion Committee was made”. (Annex: K).
To proceed further in the matter, the meeting of the Departmental Promotion Committee was required to be convened for Promotion of the concerned persons upto BPS-16 as per (Annex:J).
According to the Deputy Accountant General Administration the DPC falls in the purview of the Controller General of Accounts Islamabad. The case for convening of a DPC meeting with working paper forwarded to the Controller General of Accounts Islamabad vide letter No.Admn:I.37/Promotion AAO/3205 dated 17.01.2012 (Annex:K).
In response Accountant General K.P received a letter vide No.662/Estt.III/Court/273/2010 dated 13/3/2012 to clarify/justify the case with the following points:
• According to working Paper furnished by your office no post of AAO is vacant. Then how an official can be promoted as AAO?.
• As per FST Judgement dated 23.7.2011 para 8 consider the claim of the appellant, subject to his eligibility and suitability for promotion as AAO.Whether above said official is eligible and suitable in the light of prevailing recruitment rule and promotion rules for the post of AAO.

On 27.3.2012 this AG office received a reminder from CGA that requisite clarification/justification may be expedited to proceed further in the matter.In the reply of the reminder this office shows that there are 5 vacancies of AAOs are vacant as on 31.3.2012 and the DPC shall consider the eligibility and suitability of the petitioner as per para 8 of the FST Judgement dated 23.7.2011. The ball is rolling now in the office of CGA and AG K.P.
PRAY.
It is our pray that first our DPC may kindly be arranged immediately. Controller General of Accounts and Accountant General Khyber Pakhtunkhwa may very kindly be directed to implement the judgment of the FST and issue Notification of promotion.
